Disclosure and Control of Xtron
Deputy Public Prosecutor (DPP) Ong produced a 2008 e-mail in which Serina Wee sent to Kong and copied to Ye Peng and Eng Han
Serina wrote to Kong after the team has met Foong and he advised the team not to paint the picture that, “CHC has full control but only some control over XPL. If full control will invite consolidation.”
But Foong in his evidence to court on 13 September 2013 said he would never have given this kind of advice because this amounting to advising someone to do something dishonest.
In the court, Kong said that Foong, being a professional if he didn’t feel that there was consolidation needed, then it must be because he didn’t feel that there was full control.
DPP believes that Xtron is basically a cover for the financing of the Crossover Project.

DPP: “You’ve said that Xtron was like CHC’s GIC, right? And what the GIC does, I think we all know, is to take Singapore’s $ and invest it, correct? Why did you not also mention, since you were telling the EMs about CHC, that CHC had given you GIC $13m from the Building Fund to fund Sun Ho’s Crossover Project?”
Kong: “Your Honour, I was unaware that I needed to share that ……. it was not in the script, and I didn’t have self awareness that I needed to share that, and ……… nobody alerted me to me any of the issue, and I just ran with the script.”

Kong said….I do not deny that we have some control and some influence, but we didn’t have total control…… if it was a legal obligation to disclose, I would have disclosed it. And, your Honour, until today, nobody could still tell me if I was legally obligated to disclose that.

DPP: Witness, you are saying you were only disclosing what you were obliged to disclose, correct?
Kong: “I prefer not to share because I wanted to protect the church, I wanted to protect the mission. But again, your Honour, if I knew that I was legally obligated to share, then, no matter how much I want to protect the church from unnecessary issue, or to protect the mission, I would have done so.”

Kong: “I didn’t know that, I am seeing this now.”

DPP read the email, it says Suraj will work out the organizational structure and show Mr Tan by tomorrow 12 noon after Mr Tan had gone through with Dr Kong then we will announce to the rest of the staff. ………
DPP: “why could Suraj be working out the organizational structure of Xtron and then clearing it with Mr Tan (Tan Ye Peng) and then after that going through with you before an announcement is made?”
Kong: “Your Honour, this could be a proposal, scenario-planning yet again, and I cannot remember Pastor Tan talking to me about this. But this probably just a proposal, and I don’t think it was carried out, because Raj still working for the church, to the best of my knowledge. He didn’t leave the church payroll to work for Xtron.”
DPP: “Why would Suraj, yourself and Pastor Tan who at this time in 2006… were board members…. being involved in scenario planning for Xtron organization structure?
Kong: “Your Honour, I was not involved in the scenario planning.”
