DPP Ong
states that it was Kong's and Tan Ye Peng's decision on who to approach
to be Xtron's directors, of which Kong does not deny.
DPP Ong:
"Mr Kong, I think it is quite obvious you cannot kidnap Choong Kar Weng,
tie him up and force him to be the director against his wishes, but the
point is that you were the one who decided who would be approached to
be directors of Xtron. Kar Weng in his examination-in-chief he testified that he didn't decide Siow Ngea to be the director."
DPP Ong: "Mr Kong, do you know of anybody else who was given an
opportunity to nominate directors for Xtron, besides you, and, as we've
heard, Ye Peng was the one who approached Siow Ngea"
DPP Ong
continued by running through past circumstances in which previous
directors of Xtron were approached to be made directors without the
decision of Xtron's management.
DPP Ong put it to Kong that it
was in fact, Kong and Tan Ye Peng who were the ones that made the
decision on who to approach to be Xtron's directors.
Kong: "Your Honour, I was involved in the nomination, that I do not deny."
When Mr Seah (Sharon Tan's lawyer) stood up for the clarification of
team definition, DPP Ong stated that for the purposes of nominating and
appointing directors of Xtron, he is happy to confine it to just Kong
and Tan Ye Peng. The Judge replied that this was a helpful
clarification, as when DPP Ong mentioned about the team earlier, it
would involve more than just one other person.
